Why Dr. Dean's 84-Month Sentence is Illegal

Here are the court papers outlining why the Judge in Dr. Dean's case felt it necessary to sentence Dr. Dean to a term that is more than twice as long as the Probation Officer recommended. Readers will note that, even if everything the judge claimed in Block VIII on the last page were true, the sentence would still be illegal, as it’s a clear violation of the 1st Amendment to sentence Dr. Dean for what he allegedly said or published on his web site.

Of course, there’s nothing on his website which encourages anyone to do what he did! It’s a narrative of what he did and why he did it.

Additionally, the book the judge mentions has nothing to do with the tax laws (or lack thereof).

Finally, Dr. Dean is being sentenced for what the judge thinks Dr. Dean might do in the future. The courts have ruled that one cannot be sentenced for speculation about what the defendant might do.

No wonder the document is “Not for Public Disclosure!”
